Simulator software terms of service

1. Introduction and Company Information
These are the terms of service ("Terms") for the Lumber Kiln Simulator software ("Software") provided by Hydraterm AB, a company registered in Sweden with organization number 559337-1924.
These Terms govern your purchase and use of our Software. By purchasing, downloading, installing, or using the Software, you ("User," "you") agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Software.
2. License to Use
Subject to your compliance with these Terms and your payment of any applicable fees, Hydraterm AB grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the Software on a single device that you own or control. This license is solely for your personal or internal business use as an educational and simulation tool.
Hydraterm AB and its licensors reserve all rights not expressly granted to you in these Terms. We retain full ownership of the Software and all intellectual property rights therein.
3. Restrictions on Use
You agree that you will not, under any circumstances:

Copy, modify, adapt, translate, or create derivative works based on the Software.

Distribute, transfer, sublicense, lease, lend, or rent the Software to any third party.

Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Software, except and only to the extent that such activity is expressly permitted by applicable law despite this limitation.

Use the Software for any commercial purpose not expressly permitted by this agreement, including but not limited to reselling or distributing it.

Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices on or in the Software.

Use the Software for any illegal or unauthorized purpose.
4. Software Functionality, Liability, and Use
4.1. Intended Use
The Software is a simulator intended for educational and training purposes. The calculations and results generated are based on theoretical models. While we have made reasonable efforts to ensure the accuracy of the models, you acknowledge that simulation results may not perfectly represent real-world outcomes.

4.2. Statutory Consumer Rights
If you are a consumer, you have statutory rights under the Swedish Consumer Sales Act (Konsumentköplagen). The Software shall be considered defective if it does not conform to what has been agreed upon or what you could have reasonably expected. These Terms do not exclude or limit these statutory rights.

4.3. Limitation of Liability
Our liability for any damages arising from your use of the Software is limited to the extent permitted by mandatory Swedish law. Nothing in these Terms shall exclude or limit Hydraterm AB's liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited by law.
For business users (näringsidkare), Hydraterm AB shall not be liable for any indirect, consequential, or special damages, including but not limited to loss of profit, data, or business interruption. Our total liability in any matter arising out of or related to these Terms is limited to the amount paid by you for the Software.

4.4. Your Responsibility
You are solely responsible for any decisions and actions you take based on the output from the Software. Hydraterm AB is not liable for any physical damage to equipment (such as lumber kilns) or materials (such as lumber) resulting from decisions made based on the Software's simulation data.
5. Payment and Right of Withdrawal
5.1. Payment
The purchase of the Software is subject to a one-time payment at the price indicated at the time of purchase. Payments are processed through our designated third-party payment processor.

5.2. Consumer
Right of Withdrawal (Ångerrätt) If you are a consumer, you have a statutory right to withdraw from this agreement within 14 days of purchase without giving any reason.

5.3. Waiver of the Right of Withdrawal for Immediate Access
Our Software is delivered digitally immediately after purchase. By completing your purchase, you explicitly consent to the immediate delivery of the digital content and acknowledge that you thereby waive your 14-day right of withdrawal.
6. Termination
We may terminate your license to use the Software if you are in material breach (väsentligt avtalsbrott) of these Terms. We will provide you with a written notice of the breach. If the breach is not remedied within a reasonable period after notice is given, your license will be terminated.
Upon termination, you must immediately cease all use of the Software and destroy all copies in your possession.
7. Governing Law and Dispute Resolution
7.1. Governing Law
These Terms shall be governed by and construed in accordance with the substantive laws of Sweden.
7.2. Jurisdiction
Any dispute arising from these Terms shall be settled by the public courts of Sweden, with the Växjö district court (Växjö tingsrätt) as the court of first instance. If you are a consumer residing in another EU country, you may also be entitled to bring proceedings in your local courts.
7.3. Consumer Dispute Resolution
In case of a dispute that we cannot resolve together, you as a consumer have the right to turn to the National Board for Consumer Disputes (Allmänna reklamationsnämnden - ARN), Box 174, 101 23 Stockholm, Sweden, or visit their website at www.arn.se. We will participate in their dispute resolution process. You can also use the European Commission's online dispute resolution platform (ODR platform): http://ec.europa.eu/odr.
8. Changes to Terms
We reserve the right to modify these Terms at any time to reflect changes in our service or for legal, regulatory, or security reasons. We will notify you of any material changes. For existing licenses, the terms that were in effect at the time of your purchase will apply. Your continued use of the Software after updates have been made available may be subject to your acceptance of the new Terms.
